However, several factors mitigate this movement. Large technology companies often prefer a single, predictable federal framework to avoid the high operational costs of managing multiple state compliance protocols. Furthermore, many companies voluntarily adhere to stricter standards, such as those seen in California, to maintain consumer trust and simplify their internal engineering processes. Additionally, sector-specific federal regulations in finance, healthcare, and transportation already impose significant guardrails that limit the effectiveness of moving to states with weaker general privacy laws.
While the threat of arbitrage exists, the trend is moving toward interoperability. Many industry leaders advocate for federal preemption to ensure a level playing field and to prevent a race to the bottom in safety standards.
