No weapon is perfect. Even an AGM-114 Hellfire or a GBU-39 Small Diameter Bomb operates within a margin of error. These misses aren't always mechanical glitches or software bugs; they often stem from dust clouds, atmospheric refraction, or flawed human intelligence. When a missile hits a civilian apartment block instead of its intended target, the technology has actually functioned as designed by following its data. The failure lies in the intelligence or the execution, making technical precision a comforting fiction that masks the inherent violence of the act.
The Legal Definition of a Mistake
International Humanitarian Law (IHL) sets the standards for distinguishing a legitimate strike from a war crime. The framework relies on three principles: distinction, proportionality, and precaution. Distinction requires combatants to differentiate between military targets and civilians, while proportionality requires that the anticipated military advantage outweighs the expected loss of civilian life.
